Right to Know Requests

The Right to Know Law is Pennsylvania's Open Records Law. The law was signed by Governor Edward G. Rendell on February 14, 2008. Most of the law took effect on January 1, 2009, but the entire law took effect in three stages:

The title, definitions and creation of the Office of Open Records took effect on February 14, 2008.
July 1, 2008: All state contracts exceeding $5,000 must be posted on Treasury’s Web site. Each agency must submit to the Treasury these contracts or a summary of thereof.
January 1, 2009, the remaining portion of the law took effect.

Requests for access to public records may be made by mail, fax, e-mail or in person.

How to Submit Requests

Request may be mailed to PMSD Open Records Officer, P.O. Box 200, Pocono Mtn. School Rd, Swiftwater PA 18370-0200.
Requests may be sent by fax to (570) 839-3059.
Request may be sent as an attachment to an email.
Request may be made in person from 8:30 a.m. until 3:30 p.m. on school days at the Administration Building on the Swiftwater Campus. Requests received after 1 p.m. will be date stamped for the following business day.
Pocono Mountain School District does not accept Right to Know requests made by phone.
Pocono Mountain SD does not accept anonymous Right to Know requests.
Pocono Mountain SD may choose to deny a request for failure to submit a request using the proper form.

Filing an Appeal

When a request is denied or deemed denial, a requester may file an appeal to the Pennsylvania Office of Open Records. The appeal must be filed within 15 business days of the denial or deemed denial date. The appeal must also include the request, agency denial if one exists, and address agency grounds that the request was denied. An appeals officer will determine if the record(s) is subject to public access.
